Airbender Heating and Cooling LLC

1. Agreement to Terms
By accessing or using the website at airbenderacrepair.com (the “Site”) or engaging the services of Airbender Heating and Cooling LLC (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use our Site or services.
2. Services
Airbender Heating and Cooling LLC provides residential and commercial HVAC services in the Phoenix, Arizona metropolitan area, including but not limited to:
- Air conditioning installation, repair, and maintenance
- Heating system installation, repair, and maintenance
- Indoor air quality services
- Emergency HVAC services
Service availability is subject to geographic coverage area. We reserve the right to decline service requests at our discretion.
3. Service Area
Our primary service area includes select zip codes in the Phoenix metropolitan area. By submitting a service request, you represent that your service address falls within our coverage area. We may, at our discretion, accommodate requests outside our standard coverage area on a case-by-case basis.
4. Appointments and Bookings
When you schedule an appointment through our Site or any associated booking system:
- Appointment times are estimates and may be subject to change due to prior job delays, emergencies, or circumstances beyond our control.
- We will make reasonable efforts to notify you of any scheduling changes as soon as possible.
- You are responsible for ensuring access to the service location at the scheduled time.
- Repeated no-shows or last-minute cancellations without notice may result in a refusal of future service.
5. Pricing and Payment
All pricing for services will be communicated prior to work commencing. By authorizing us to perform work, you agree to pay the quoted amount upon completion of services unless otherwise agreed in writing.
We reserve the right to adjust pricing if the scope of work changes once on-site. You will be informed of any changes before additional work proceeds.
6. Warranties and Disclaimers
We stand behind the quality of our work. Warranty terms, if applicable, will be communicated at the time of service. To the fullest extent permitted by law:
- We make no guarantees regarding outcomes beyond the scope of the specific service performed.
- We are not responsible for pre-existing conditions, defects, or damage unrelated to our work.
- The Site and its content are provided “as is” without warranties of any kind, express or implied.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Airbender Heating and Cooling LLC’s total liability to you for any claim arising out of or relating to our services or these Terms shall be limited to the amount you paid us for the specific service giving rise to the claim.
In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.
8. Indemnification
You agree to indemnify, defend, and hold harmless Airbender Heating and Cooling LLC and its members, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of our Site or services, your violation of these Terms, or your violation of any rights of another party.
9. Privacy
Your use of our Site and services is also governed by our Privacy Policy, available at airbenderacrepair.com/privacy-policy. By using our Site or services, you consent to the practices described therein.
10. SMS and Electronic Communications
By providing your phone number and/or email address and submitting a form on our Site, you consent to receive service-related communications from us, including appointment confirmations, reminders, and follow-up messages. Standard message and data rates may apply for SMS communications.
You may opt out of SMS communications at any time by replying STOP to any text message. You may opt out of email communications by following the unsubscribe instructions in any email we send.
Carrier Liability. Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your wireless provider/network and is not guaranteed.
Age Restriction. Our SMS program is only available to individuals who are at least 18 years of age. By opting in to receive text messages from us, you represent and warrant that you are 18 years of age or older.
11. Intellectual Property
All content on the Site, including text, graphics, logos, and images, is the property of Airbender Heating and Cooling LLC or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
12. Third-Party Links
Our Site may contain links to third-party websites. These links are provided for convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.
13. Dispute Resolution
In the event of any dispute arising out of or relating to these Terms or our services, the parties agree to first attempt to resolve the dispute through good-faith informal negotiation for a period of at least 30 days before initiating any formal proceedings.
If informal resolution fails, any dispute shall be resolved through binding arbitration in Maricopa County, Arizona, in accordance with applicable arbitration rules. We agree to pay arbitration fees if deemed excessive by the arbitrator. The arbitrator’s decision shall be final and binding.
Notwithstanding the above, either party may seek injunctive or other equitable relief in the state or federal courts located in Maricopa County, Arizona.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be brought exclusively in the courts of Maricopa County, Arizona.
15. Limitation on Time to File Claims
Any cause of action or claim you may have arising out of or relating to these Terms or our services must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action or claim is permanently barred.
16. Changes to Terms
We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to the Site. Your continued use of the Site or our services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Site and our services, and supersede all prior agreements and understandings, whether written or oral, relating to such subject matter.
